RED MAMLa ATTENDS THE 110th SESSION OF THE LEGAL COMMITTEE AT IMO

The Secretary General of the International Maritime Organization (IMO) Kitack Lim, inaugurated the Legal Committee in its 110th session, from March 27 to 31, 2023, at the IMO headquarters, London, chaired by Ms. Gillian Grant (Canada) and in which our Permanent Representative for the Bolivarian Republic of Venezuela and member of the Legal Committee of our Network, Ms. Lizett M. Carrero, participated.
The working agenda addressed issues related to the fair treatment of seafarers in case of detention; the practice of ship-to-ship transfers of oil on the high seas and the consequences and concerns regarding the global liability and compensation regime, as these are high-risk activities that undermine the international regime in terms of maritime safety, environmental protection and liability and compensation.

Port States must ensure compliance by these ships with the safety and liability conventions and ensure that ship-to-ship transfer operations are carried out in accordance with the applicable safety requirements of the IMO conventions; another point addressed was the prevention of illicit practices related to fraudulent registration and fraudulent ship registers.
 
A resolution (LEG.6(110)) was also adopted to provide guidelines for port State and flag State authorities on how to deal with cases of abandonment of seafarers. 

The Committee adopted the Claims Manual relating to the International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001. 

Information brochures on the Civil Liability Convention, the Bunkers Convention and the Nairobi International Convention on Wreck Removal were approved to provide information on the treaties and encourage their implementation.

A workshop on the 2010 HNS Convention was held on April 3 and 4, with broad participation of Member States and organizations represented there, to assist Member States in their efforts to promote ratification of the 2010 HNS Protocol, which is necessary to ensure that those who have suffered damage have access to a comprehensive, international liability and compensation regime.

Another area of interest is the Convention on the International Effects of Judicial Sales of Ships, the Committee welcomed the adoption of the Convention on 7 December 2022 by the United Nations General Assembly.  Its central provision is contained in Article 6, which states: "Any judicial sale in respect of which the certificate of judicial sale referred to in Article 5 has been issued shall have the effect, in the other States Parties, of conferring upon the buyer a clear title to the ship".
